Acceptable Use Policy

This Acceptable Use Policy ("AUP") outlines the prohibited uses of the Ekomspace Service ("Service") and any website or content hosted on our infrastructure. This AUP is incorporated by reference into the Ekomspace Terms of Service. By using the Service, You agree to abide by this AUP.

Violation of this AUP may result in the immediate suspension or termination of Your Ekomspace account, at Our sole discretion, and without refund.

1. Prohibited Content

You may not use the Service to upload, publish, or transmit any Content that falls into the following categories:

1.1. Illegal Content

• Any content that is illegal under the laws of the State of Delaware, U.S.A., the jurisdiction where You operate, or any jurisdiction where Your customers reside.
• Content that encourages illegal acts, hatred, discrimination, or violence.

1.2. High-Risk & Regulated Products (Strictly Prohibited)

• Explicit Adult Content & Pornography: Content depicting explicit sexual acts, illegal sexually explicit material, or materials primarily focused on the gratification of prurient interests.
• Gambling & Regulated Gaming: Offering or promoting any form of regulated gambling unless You provide verifiable evidence of all necessary regulatory licenses.
• Illegal Drugs or Controlled Substances: The sale, promotion, or distribution of illegal drugs, narcotics, or any prescription drug without the required authorization.
• Weapons: The sale or distribution of weapons, firearms, ammunition, or related parts.
• Counterfeit/Unauthorized Goods: The sale or distribution of products that infringe upon the intellectual property rights of others.

1.3. Harmful and Defamatory Content

• Content that is defamatory, harassing, abusive, or threatening.
• Content that promotes self-harm, suicide, or terrorism.

2. Prohibited Activities

2.1. System Abuse and Hacking

• Overloading: Any activity that imposes an unreasonable load on our infrastructure.
• Security Violations: Any attempt to gain unauthorized access to Our systems.
• Malware and Viruses: Uploading or distributing malware or any malicious code.
• Code Vulnerabilities: You are responsible for the security of any custom code integrated into Your store.

2.2. Fraud and Financial Crimes

• Phishing/Scamming: Activities designed to deceive users.
• Financial Fraud: Pyramid schemes, ponzi schemes, money laundering, or any deceptive financial practices.

2.3. Spam and Unsolicited Communications

• Sending unsolicited bulk commercial email (spam).
• Using Ekomspace resources to send communications that violate the CAN-SPAM Act, the GDPR, or any other applicable anti-spam laws.

2.4. Data Misuse

• Falsely representing your store's legal status, location, or the source of your products.
• Using the Service to collect, process, or store personal data in violation of applicable data protection laws.

3. Enforcement and Right to Monitor

3.1. Ekomspace's Right to Action

Ekomspace reserves the right to investigate any violation of this AUP. We may, at any time and without prior notice, remove or modify any Content or suspend or terminate Your account for violating this AUP.
